1. Preamble
SUSTAINIMMO is committed to protecting the privacy of visitors and users of its website accessible at https://www.sustainablerealestate.fr (the “Site”), and makes every effort to do so. In particular, SUSTAINIMMO undertakes to ensure a level of protection for personal data in compliance with the General Data Protection Regulation (“GDPR”), including all French laws and regulations implementing, supplementing, or replacing the GDPR where applicable.
SUSTAINIMMO collects and processes, through cookies and other trackers, personal data relating to Visitors and Users of the Site. “Visitors” refers to natural persons who access and use the Site without having created a personal account and who provide their personal data to SUSTAINIMMO via the “contact” page. “Users” refers to natural persons who have created an account on the Site.
Visitors and Users are collectively referred to as the “Data Subjects.”
This cookies policy (the “Cookies Policy”) describes the terms and conditions of the collection and processing of Data Subjects’ personal data through cookies and other trackers.
The personal data processing operations are carried out by SUSTAINIMMO, a simplified joint-stock company with a share capital of €20,000, whose registered office is located at 9 rue Anatole de la Forge, 75017 Paris, registered with the Paris Trade and Companies Register under number 932 944 002 (“SUSTAINIMMO”).
2. What is a cookie?
A cookie is a small text file placed by the Site’s servers under the control of SUSTAINIMMO and stored locally by the browser in a dedicated space on the hard drive or device of the Data Subject (computer, tablet, mobile phone, or any other device connected to an electronic communications network) when accessing content published on the Site or an online advertisement.
The file can only be read by its issuer, namely SUSTAINIMMO, and allows it, during the cookie’s validity period, to recognise the relevant device each time it accesses content containing cookies from that issuer.
Cookies allow SUSTAINIMMO to store information about the Data Subject’s browsing activity on the Site.
Before placing these cookies, SUSTAINIMMO seeks the Data Subject’s consent in accordance with the law, except where an exemption applies.
3. What cookies does SUSTAINIMMO use?
● Strictly technical cookies
Some of the Site’s features cannot function without the use of certain cookies (technical or functional cookies), which are essential for browsing the Site and using its functionalities. In this case, the law does not require SUSTAINIMMO to obtain the Data Subject’s prior consent to set these cookies.
These include “session ID” cookies, which enable the User to remain logged in throughout their browsing session on the Site without needing to re-enter their username and password. These cookies also allow the User to reconnect to the Site without re-entering their login credentials.
● Other cookies
Aside from strictly technical cookies, and after obtaining the Data Subjects’ prior consent, SUSTAINIMMO uses performance and audience measurement cookies, targeted advertising cookies, and conversion tracking cookies, as further described in Section 5.
● Cookies from third-party websites
The Site may contain links to other websites. SUSTAINIMMO does not know what cookies are used by these websites. For more information, please refer to the cookie information provided by these third parties on their own sites.
4. What data is collected through cookies?
SUSTAINIMMO indirectly collects, through cookies, browsing-related data from the Data Subject, such as:
● Identification data: the Data Subject’s IP address
● Device identifier: operating system used, information on browser type and version, Data Subject’s internet service provider
● Acceptance data: pages visited, duration of pages viewed
The data collected is not used by SUSTAINIMMO to cross-check with other data processing operations.
5. For what purposes does SUSTAINIMMO use cookies?
SUSTAINIMMO collects personal data through cookies and other trackers in order to understand how Data Subjects browse the Site, to obtain data that will enable SUSTAINIMMO to improve future browsing experiences, to provide personalised offers to Data Subjects, to identify Users when they access their accounts, to measure the Site’s audience and performance, to measure conversion rates and the impact of advertising campaigns on social networks, and to carry out targeted advertising.
The purposes, legal bases, and validity periods are set out below:

6. Who receives the cookies data?
Information collected through cookies strictly necessary for providing the User-requested service is not shared with third parties, except for the Site’s hosting provider, which stores all data.
Information relating to performance, audience measurement, and conversion tracking may be used by SUSTAINIMMO or by third parties. The recipients of this data are Google, Facebook, Instagram, and LinkedIn, each for their respective data.
Data collected through cookies may also be shared with:
● Individuals authorized by SUSTAINIMMO to process this data after signing a confidentiality agreement, including SUSTAINIMMO employees
● SUSTAINIMMO’s external advisors: lawyers, accountants, statutory auditors, all bound by confidentiality obligations
● Authorities: as required by law, judicial requisition, and/or court decision
● Any third party in the event of a merger, acquisition, partial or total asset transfer, change of direct or indirect control, or any other restructuring undertaken by SUSTAINIMMO
7. What can the Data Subject do regarding cookies?
Once the Data Subject has accepted the use of cookies, their Internet browser automatically sends information to SUSTAINIMMO, such as their IP address, the version of the browser they use, and their browsing activity on the Site (e.g., pages visited).
The Data Subject may configure their browser at any time to receive a notification when a cookie is set or to refuse the use of cookies.
Most browsers are set by default to accept all cookies, but the Data Subject may choose to accept all cookies, reject them systematically, or choose which cookies to accept depending on their purpose, by adjusting the browser settings. SUSTAINIMMO warns the Data Subject that refusing certain cookies may degrade their user experience.
SUSTAINIMMO informs the Data Subject that they may withdraw their consent at any time by modifying these settings.

Disabling advertising cookies does not mean that the Data Subject will not receive any advertisements, but that the advertisements will no longer be tailored to their interests.
8. What rights do Data Subjects have?
Data Subjects have the right to access, rectify, erase, and port their personal data, as well as the right to object to and limit processing, under applicable regulations.
SUSTAINIMMO may request Data Subjects’ explicit consent to process their personal data, as described in Section 5. In this case, Data Subjects may withdraw their consent at any time for processing carried out by SUSTAINIMMO for targeted advertising, behavioural advertising, audience measurement, and conversion tracking, as explained in Section 7.
Withdrawing consent will not affect the user’s experience on the Site outside the scope of the processing concerned.

If Data Subjects believe their rights have not been respected, they may lodge a complaint with the French Data Protection Authority (CNIL).
9. How long does SUSTAINIMMO retain personal data?
SUSTAINIMMO retains data collected through cookies only for the period strictly necessary for the purposes described in Section 5, i.e., 25 months.
Data Subjects’ data is then archived with restricted access for an additional period in order to allow SUSTAINIMMO to comply with its legal and regulatory obligations relating to data retention and archiving. After this additional period, the data is permanently deleted from SUSTAINIMMO’s databases.
10. Are Data Subjects’ personal data transferred abroad?
With the Data Subject’s consent, their data may be transferred abroad, particularly to service providers located in the United States that provide SUSTAINIMMO with audience measurement, conversion tracking, and targeted advertising services. SUSTAINIMMO implements the necessary safeguards—particularly contractual safeguards—to ensure an adequate level of protection for such international transfers.
11. Amendments to the Cookies Policy
SUSTAINIMMO reserves the right to amend and/or update this Cookies Policy. The revised Cookies Policy will be posted on the Site with an indication of the date of the latest update.
